Termination agreement (Aufhebungsvertrag)

What a termination agreement is and what to check before you sign.

With a termination agreement, you and your employer end the employment together. It only applies once you sign it.

The essentials

  • It must be in writing and signed by both sides. An email is not enough.
  • Notice periods and protection against dismissal do not apply. Once signed, it is usually very hard to challenge.
  • You do not have to sign right away. You may ask for time to think and get advice.

Myth: A termination agreement is the same as a dismissal.

Fact: No. A dismissal is declared by one side alone. You have to agree to a termination agreement – you can also say no.

Before you sign

Read the agreement calmly and check these points.

What should you check?

  • 📅 When does the employment end?
  • 💶 Is there a severance payment, and how much?
  • 🏖️ What happens to remaining holiday and overtime?
  • 📄 Will you get a good reference?
