Enforcement order (Vollstreckungsbescheid) – what does it mean?

How it differs from a court payment order (Mahnbescheid) and what enforcement generally means.

An enforcement order (Vollstreckungsbescheid) may follow if no objection (Widerspruch) was filed against a court payment order (Mahnbescheid). It generally allows the creditor to start enforcement.

Key points

  • An enforcement order (Vollstreckungsbescheid) is an enforceable title (Vollstreckungstitel). It can be used for many years.
  • Enforcement means that a claim is enforced with state assistance – for example through attachment of your bank account (Kontopfändung) or wages (Lohnpfändung), or through a bailiff (Gerichtsvollzieher).
  • Even then, legal protections are available, for example through a P-Konto and protected income thresholds (Pfändungsfreigrenzen).
  1. Court payment order (Mahnbescheid) is served
  2. No objection (Widerspruch) within the deadline
  3. Creditor applies for an enforcement order (Vollstreckungsbescheid)
  4. An objection (Einspruch) can be filed within 2 weeks
  5. Enforcement can then take place, for example through seizure of assets (Pfändung)
