With a written warning, the employer shows that they will not accept a certain behaviour. It is a warning, not yet a dismissal.
The essentials
- A warning names the behaviour exactly and warns that a dismissal may follow if it happens again.
- It is often required before someone can be dismissed because of their behaviour.
- The law does not require a specific form. It usually comes in writing.
- Misconduct is alleged
- Warning received
- Check the allegation
- Reply if needed
You can describe your view in writing and ask for it to be added to your personnel file.
If a warning is unjustified, you can ask for it to be removed from your personnel file. The works council, a union or an advice centre can help.
MeaNext explains general rules about work in Germany. This information does not replace individual legal advice. In a specific case, your employment contract, collective agreement, works agreement and personal circumstances can be decisive.
